General Conditions of Passengers and Luggages Transport
The transport of passengers and luggage is offered by Belle Air, based on the
following conditions.
Conditions of purchase; Ticket modifications; Transport conditions
CONDITIONS OF PURCHASE
1. Definitions
1.1. Considering the current General Conditions of Transport, the following
terms will have sense next to the indicated ones, except for the cases when it
is differently specified in function of the context:
- Adults: meaning passengers more than 11 years old, the moment of the flight;
- Luggage: meaning the goods owned or possessed by the passenger that accompany
him during the flight, except for the case when they are differently specified;
luggage means the registered or the non-registered one;
- Registered luggage: meaning the luggage taken care by the company, for which
a Coupon for the Identification of the Luggage is issued;
- Non-registered luggage: meaning the hand-luggage that the passengers takes
with him on board of the aircraft and all the luggage that its not registered;
- Ticket: meaning a transport document issued by the company, named Ticket of
the Passenger and Receipt of the Luggage, or the confirmation and the summary
of the flight data including also the Confirmation number, always issued by the
company and of which the current General Condition make up a substantial and
integrant part, as well as the boarding card issued at the check-in;
- Call Center: meaning the center of the telephonic assistance of the company
and to which the passengers can be addressed to receive general information on
the flight, also to ask information on the purchase of the tickets;
- General Conditions of Transport: meaning these General Conditions of
Passengers and Luggages transport;
- Reference Code of Reservation: meaning the code communicated by the company
to the passenger to identify the reservation made and confirmed;
- Warsaw Convention: meaning the Convention for the unification of some
regulations, regarding the international air transportation, signed in Warsaw
on October 12, 1929.
- Withdrawal Special Rights: meaning the unity of the account, defined by the
IMF and subject to daily quotation, published on the managers daily;
- Infant: meaning every passenger of 2 (or less) years old, at the flight
moment;
- Passenger: meaning every person, except for the members of the staff, that
the company transports or undertakes to transport;
- PIR Property Irregular Reports: meaning the module available at the
airports for the complaints of the passengers concerning the damages or the
delay of the luggage;
- The luggage receipt: meaning those parts of the ticket that regard the
transport of the registered luggage and the passenger;
- Company: meaning Belle Air, with the headquarters in: Blv. Zogu I, Nr. 1
(Qendra Tregtare Tirana), Tirana, ALBANIA, tel: + 355 (0)4 240 175, fax: + 355
(0)4 240 213, NIPT K 51817001T, and supplier of the transport of the passengers
and luggage, object to the current General Conditions, also all the contractual
air companies that undertake to transport the passengers and luggage
2. Knowledge and acceptation of the General Conditions of the contract
The actual General Conditions can be updated or modified in any moment by the
company, which provides to communicate them through the current website. The
present Conditions must be examined online by the passenger or can be requested
at the Call Center before booking. Therefore, the reservation implies total
knowledge of their integral acceptation. If the reservation is made online, the
passenger undertakes to preserve the current General Conditions; similarly, the
passengers undertakes to preserve the current General Condition every time he
makes a modification. The purchased ticket for the transport of the passenger
valid on the scheduled Belle Air flights are marked by the diction Valid Belle
Air only.
3. Booking and buying the ticket
3.1. The ticket can be bought through the current site (www.belleair.al),
contacting the Call Center, at the travel agency or at the ticket offices of
the company. The Call Center can be contacted at this number: +355 (0) 4
240175. A surcharge of 5 Euros will be applied directly on the ticket for the
rights of transactions for every payment made.
3.2. The purchase of the ticket contextual to the reservation.
The company will verify the payment of the tariff, as well as the payment of
all the taxes and the applicable surcharges and, therefore, will confirm the
reservation, communicating to the passenger the Reference Code of
Reservation.If the payment will not be executed or completed, the company will
have the right to cancel the reservation.
3.3. For online reservations, trough the site, the confirmation of the booking,
together with the Reference and Resesvation Code and the summarizing data of
the purchased flight, will be sent from the carrier to the passenger by email.
For reservations made by phone call through the Call Center, the confirmation
of the booking, the Reference and Reservation Code and the summarizing data of
the purchased flight, will be communicated from the carrier to the passenger in
one of the following ways, as chosen by the passenger
- through fax
- through e-mail
In hypotheses of buying the ticket at an agency, the latter will deliver to the
passenger the Reference of the Reservation and the data of the flight.
3.4. In case of operational or time-table changes, the communications will be
transmitted from the company to the passenger through e-mail, to the e-mail
address indicated at the reservation. It is the passenger who should check his
mail for eventual operational modifications of the flight.
3.5 The tickets can be bought until three hours before the departure of the
flight.
3.6. The reservation has one year validity after being confirmed by the
company.
3.7. The tickets will only be Economy Class and can be one way or two ways.
3.8. It is possible to by up to maximum 15 places for transactions.
4. Tariffs and modalities of payment
4.1 The tariffs include only the transport from the departure airport to the
destination airport, so, excluding the transport between airports and/or
airports and terminals. The applied tariffs are those at the moment of
reservation, for which a limited number of places available exist. The tariffs
can vary before the flight according to the number of places still available at
the moment of the purchase. The company has the right to refuse the transport
if the applicable tariff has not been paid.
4.2 As far as the transport of luggage is concerned, following article 11 of
the actual general conditions, and in addition to the tariff, in charge of the
passenger will be, for every ticket purchased, all the taxes imposed by the
government, or other authorities, in particular the airports, relating the
passenger or his luggage, or all the services, also the crisis surcharge and
the fuel surcharge, variable in relation to single airports of origin and
destination. The tariffs and the taxes will be paid in Euros.
4.3 The infants and children of less than 2 years old, can fly sitting together
with an adult, with 10% of the tariff available for adults, plus crisis
surcharge and fuel surcharge. They dont have the right of a quota for the
luggage.
4.4 The payments can be made with a credit card MasterCard, Visa, American
Express and Diners. For every transaction a commission of 6 Euros will be
applied to the passenger for the rights of transaction.
5. Preservation
To guarantee the preservation of the data of the credit cards used online, the
company has the most advanced technology Secure Socket Layer (SSL). SSL
actually is the favorite method for the secure transfer of the data of the
credit cards and of other data preserved through Internet. The moment of
payment, if the browser used supports SSL, the passenger can select the option
Modalities of Reservation, and the data will be protected by this technology.
If the browser imposes limitations, it is possible to use the modality
not-protected; nevertheless the company recommends to procure the most recent
version of the browser to perform with tranquility the future transactions.
MODIFICATIONS OF THE TICKET
6. Changes, Annulments and Cancellations
6.1. In case the passenger wants to annul the flight, change the itinerary, the
name, the date or time of flight indicated in the reservation, the following
regulations should be applied.
PROMOTIONAL (W, V, P)
Cancellation: The fee is not refundable. It is possible to request the
reimbursement of the government taxes (airport IT, AL; area Schengen QX) 24
hours before the date of departure of the purchased flight. The fees of the
carrier is not refundable (fuel surcharge Q; carrier surcharge YQ).
Changing date/time: The date and the time of departure may be modified up to 3
hours before departure of the purchased flight by paying a penalty and booking
the new flight on the same class of booking; if the latter is not possible, it
is possible to pay the difference with the immediate higher available tariff,
plus a penalty of 50.00 Euro.
Changing route: The route can be modified up to 3 hours before departure of the
purchased flight by paying a penalty and booking the new flight on the same
class of booking; if the latter is not possible, it is possible to pay the
difference with the immediate higher available tariff, plus a penalty of 50.00
Euro.
Changing name: The change in name is allowed up to 3 hours before departure of
the purchased flight by paying a penalty of 80.00 Euro and booking the new
flight on the same class of booking; if the latter is not possible, it is
possible to pay the difference with the immediate higher available tariff, plus
a penalty of 80.00 Euro.
Failure to show on the purchased flight (non show) is not entitled to any
refunding.
Denied boarding due to lack of travel documents is not entitled to any
refunding.
PROMOTIONAL (N,G)
Cancellation: The fee is not refundable. It is possible to request the
reimbursement of the government taxes (airport IT, AL; area Schengen QX) 24
hours before the date of departure of the purchased flight. The fees of the
carrier is not refundable (fuel surcharge Q; carrier surcharge YQ).
Changing date/time: The date and the time of departure may be modified up to 3
hours before departure of the purchased flight by paying a penalty and booking
the new flight on the same class of booking; if the latter is not possible, it
is possible to pay the difference with the immediate higher available tariff,
plus a penalty of 40.00 Euro.
Changing route: The route can be modified up to 3 hours before departure of the
purchased flight by paying a penalty and booking the new flight on the same
class of booking; if the latter is not possible, it is possible to pay the
difference with the immediate higher available tariff, plus a penalty of 40.00
Euro.
Changing name: The change in name is allowed up to 3 hours before departure of
the purchased flight by paying a penalty of 80.00 Euro and booking the new
flight on the same class of booking; if the latter is not possible, it is
possible to pay the difference with the immediate higher available tariff, plus
a penalty of 80.00 Euro.
Not showing up for the flight (non show) does not entitle to any kind of
refund.
To be denied from boarding because of the lack of travel documents does not
entitle to any kind of refund.
Failure to show on the purchased flight (non show) is not entitled to any
refunding.
Denied boarding due to lack of travel documents is not entitled to any

ECONOMY1 (Z, Y, U, Q, J)
Cancellation: in case of flight waiver the fee is not refundable. It is
possible to request the reimbursement of the government taxes (airport IT, AL;
area Schengen QX) 24 hours before the date of departure of the purchased
flight. The fees of the carrier is not refundable (fuel surcharge Q; carrier
surcharge YQ).
Changing date/time: The date and the time of departure may be modified up to 3
hours before departure of the purchased flight by paying a penalty and booking
the new flight on the same class of booking; if the latter is not possible, it
is possible to pay the difference with the immediate higher available tariff,
plus a penalty of 30.00 Euro.
Changing route: The route can be modified up to 3 hours before departure of the
purchased flight by paying a penalty and booking the new flight on the same
class of booking; if the latter is not possible, it is possible to pay the
difference with the immediate higher available tariff, plus a penalty of 30.00
Euro.
Changing name: The change in name is allowed up to 3 hours before departure of
the purchased flight by paying a penalty of 80.00 Euro and booking the new
flight on the same class of booking; if the latter is not possible, it is
possible to pay the difference with the immediate higher available tariff, plus
a penalty of 80.00 Euro.
Not showing up for the flight (non show) does not entitle to any kind of
refund.
Failure to show on the purchased flight (non show) is not entitled to any
refunding.
Denied boarding due to lack of travel documents is not entitled to any
refunding.
ECONOMY2 (F, D, C, A)
Cancellation: The fee is not refundable. It is possible to request the
reimbursement of the government taxes (airport IT, AL; area Schengen QX) 24
hours before the date of departure of the purchased flight. The fees of the
carrier is not refundable (fuel surcharge Q; carrier surcharge YQ).
Changing date/time: The date and the time of departure may be modified up to 3
hours before departure of the purchased flight by paying a penalty and booking
the new flight on the same class of booking; if the latter is not possible, it
is possible to pay the difference with the immediate higher available tariff,
plus a penalty of 30.00 Euro.
Changing route: The route can be modified up to 3 hours before departure of the
purchased flight by paying a penalty and booking the new flight on the same
class of booking; if the latter is not possible, it is possible to pay the
difference with the immediate higher available tariff, plus a penalty of 30.00
Euro.
Changing name: The change in name is allowed up to 3 hours before departure of
the purchased flight by paying a penalty of 50.00 Euro and booking the new
flight on the same class of booking; if the latter is not possible, it is
possible to pay the difference with the immediate higher available tariff, plus
a penalty of 50.00 Euro.
Failure to show on the purchased flight (non show) is not entitled to any
refunding.
Denied boarding due to lack of travel documents is not entitled to any

ECONOMY2 (X, L)
Cancellation: The fee is not refundable. It is possible to request the
reimbursement of the government taxes (airport IT, AL; area Schengen QX) 24
hours before the date of departure of the purchased flight. The fees of the
carrier is not refundable (fuel surcharge Q; carrier surcharge YQ).
Changing date/time: The date and the time of departure may be modified up to 3
hours before departure of the purchased flight by paying a penalty and booking
the new flight on the same class of booking; if the latter is not possible, it
is possible to pay the difference with the immediate higher available tariff,
plus a penalty of 30.00 Euro.
Changing route: The route can be modified up to 3 hours before departure of the
purchased flight by paying a penalty and booking the new flight on the same
class of booking; if the latter is not possible, it is possible to pay the
difference with the immediate higher available tariff, plus a penalty of 30.00
Euro.
Changing name: The change in name is allowed up to 3 hours before departure of
the purchased flight by paying a penalty of 50.00 Euro and booking the new
flight on the same class of booking; if the latter is not possible, it is
possible to pay the difference with the immediate higher available tariff, plus
a penalty of 50.00 Euro.
Failure to show on the purchased flight (non show) is not entitled to any
refunding.
Denied boarding due to lack of travel documents is not entitled to any
refunding.
NORMAL (K, I, H, E, T, S, R, M, B)
Cancellation: The fee allows refunding with a penalty of 100 (one hundred
euro). It is possible to request the reimbursement of the government taxes
(airport IT, AL;GR;TR area Schengen QX) 24 hours before the date of departure
of the purchased flight. The fees of the carrier is not refundable (fuel
surcharge Q; carrier surcharge YQ).
Changing date/time: The date and the time of departure may be modified up to 3
hours before departure of the purchased flight by paying a penalty and booking
the new flight on the same class of booking; if the latter is not possible, it
is possible to pay the difference with the immediate higher available tariff,
plus a penalty of 30.00 Euro.
Changing route: The route can be modified up to 3 hours before departure of the
purchased flight by paying a penalty and booking the new flight on the same
class of booking; if the latter is not possible, it is possible to pay the
difference with the immediate higher available tariff, plus a penalty of 30.00
Euro.
Changing name: The change in name is allowed up to 3 hours before departure of
the purchased flight by paying a penalty of 50.00 Euro and booking the new
flight on the same class of booking; if the latter is not possible, it is
possible to pay the difference with the immediate higher available tariff, plus
a penalty of 50.00 Euro.
Failure to show on the purchased flight (non show) is not entitled to any
refunding.
Denied boarding due to lack of travel documents is not entitled to any
refunding.
**If for the flights R/T composed of 2 fees of O/W is given ONLY one ticket
only ONE change in name is possible, to be made up to 3 hours before the flight
departure.

CONDITIONS OF TRANSPORT
7. Check-in and administrative formalities
7.1 The passenger should show at the check-in moment the copy of the
confirmation of the reservation received by e-mail, necessary for the boarding.
The company can not allow the passenger to board if this document is missing.
7.2. The passenger must turn up at the airport on time for the shipping, before
the departure of the flight, and the operations of check-in; the counter of the
carrier opens about one hour and a half before the departure and closes 35
minutes before the scheduled time of departure. If the passenger arrives at the
check-in counter of the carrier or at the gate past the limits of the above
mentioned timetable, the carrier will have the right to cancel the seat
reserved to the passenger. The assignment of seats is done the moment of the
boarding. It is not possible to pre-assign the seats.
7.3. The day of the departure, the passenger should turn up at the check-in
counter with a valid identification document such as: valid passport (underage
of 14 years should have birth certificate with picture, issued by the Commune
of residence) and the ticket communicated by the company at the moment of the
purchase confirmation. The passenger should besides have the documents required
by the legislation of the destination countries to enter their territory. It is
the responsibility of the passengers to have a valid identification document
and further required documents or documents requested by the customer and
immigration authorities. Fines, sanctions, expenses or related issued costs
because of the absence of any of these documents will be in charge of the
passenger. The passengers are asked to call the authorities of the immigration
office of the destination country for eventual explanations before reserving
the ticket. If the documents of the passengers do not result valid or if the
name of the passenger written in the reservations does not correspond to the
name on the identification document, the carrier has the right to refuse the
boarding and the passenger will not have the right of reimbursement.
8. Special assistances
For any type of assistance or for the procedures of transport of infants,
underage children not accompanied, pregnant women, carriers of handicaps, it is
necessary to contact directly the Call Center before booking. In the same way,
the passenger should contact directly the Call Center for the boarding and the
transport of the bicycles, surf-tables, skis, animals. The reservation of the
flight must be exclusively done through the Call Center. The relative policies
and procedures are subject to variation without warning. Every underage
passenger, under 11 years, should be accompanied by an adult passenger, by
requesting specific service of accompaniment when making the reservation
through the Call Center. The company will not accept on board more than one
infant passengers (0-2 years not turned yet) accompanied by only one adult
passenger.
9. The conduct on board of the aircraft
On all the aircrafts of the carrier smoking is not allowed. The inobservance of
this kind of prohibition allows to take legal actions and paying a fine of 1000
Euros. On board of the aircrafts it is not allowed consuming alcoholic
beverages brought by the passengers themselves or offered by third parties. In
conform with the normative dispositions, national and international, the
aircraft is subject to the command of the captain of the flight and all the
persons on board must follow his indications rigorously. The commandant is
authorized to proceed against the passengers that behave incorrectly or are
disturbing. The passenger will be held responsible of the damages caused to the
carrier or to third parties with their behavior, with consequent obligation of
the passenger to recompense every kind of damage caused in this way to the
company and/or to third parties.
10. Refusal or limitation of transport
The company can refuse the boarding or the continuation of the transport of the
passenger or the luggage or cancel his reservation if:
a) it is necessary for security or public order reasons;
b) it is necessary in order to avoid the violation of the laws of the state of
departure, arrival or over-fly
c) the behavior, the state or the mental or physical conditions of the
passenger are such to:
- make necessary a special help by the part of the carrier, that the latter can
or cannot provide only by sustaining disproportionate costs; or
- act in a noticeable way or repeat discomforting actions such as to make it
impossible for other passengers to accept his presence; or
- put in danger his own and/or other passengers and/or the flight personnel
objects;
d) the passenger has been behaving in an unacceptable way in a previous flight
and could repeat such behavior
If the transport service cannot be done by the carrier for one of the above
mentioned reasons or if for one of these reasons the reservation is cancelled,
no reimbursement will be given to the passenger.
11. Luggage
11.1. For each passenger, except for the infants who have no right of luggage,
the weight limit of the registered luggage is 20 kg total for a maximum of two
luggage. For every kilogram over this limit, the payment of 6.00 Euros is
provided. In international flights of business class, 30 kg of luggage is
allowed. The space between the length, height and the depth of each luggage
should not be more than 160 cm.
11.2. The transport of bicycles and tables of windsurf is subject of payment of
an extra tariff of 26.00 Euros per flight and per object.
11.3. The transport of water or snow skis is free if they are not longer than
160 cm, and do not exceed the allowance of the luggage, otherwise it will
always be asked the payment of 25.00 Euros.
11.4. The transport of weapons is subject to the payment of a supplementary
tariff that varies according to the airport of departure and the one of
arrival. Contact the Call Center Belle Air +355 (0)4 240 175 to be informed
about the tariffs.
11.5. The company accepts maximum 2 animal on board and 1 with the registered
luggage per flight. The passenger should bring the container for the transport
of the animal, the dimensions of which should not exceed 45 x 30 x 25 cm
(length, depth, height) for the transport on board of the aircraft and cm 60 x
90 x 60 for the transport with the registered luggage. Only one animal is
allowed per container. The company has the right to refuse the transport of
animals if the above criteria are not met. We also remind you that the
passenger should have the booklet with the vaccinations of the animal, and, for
flights within the countries of EU, the Passport issued by the veterinarian
services of the USL Company. The reservations should be made only and
exclusively through the Call Center to be able to eventually guarantee this
kind of assistances.
11.6. To verify the availability of space on board of the aircraft for the
transport of the objects and animals (about which see paragraphs 11.2, 11.3,
11.4), the passenger should contact the call Center with congruous advance
before the departure. Otherwise, the acceptance of such objects or animals at
the moment of the check-in may not be guaranteed; the passenger reserving the
transport of the animals or objects should have the reservation made through
the Call Center.
11.7. The applicable tariffs for the transport of the luggage or animals should
be paid at the moment of their registration at the ticket office of the airport
or at the travel agency at the moment of reservation of the departing flight.
11.8. On board of the aircraft every passenger can bring only one hand-luggage
not registered with a weight not exceeding 10 kg and dimensions not exceeding
100 cm (sum of length + height + depth).
11.9. The company will not accept as luggage not registered fragile or
perishable objects, money, jewelry, silverware, or precious metals,
actions/stocks or other similar things, not even commercial or official
documents, samples, passports or other identification documents.
11.10. On the not registered/registered luggage the passengers should place a
label with their name and surname. The luggage handed by the passenger without
this label will not be accepted by the company. Labels to distinguish the
luggage are available at the airport at the check-in counter of the company.
11.11. The company doesnt take any responsibility for: fragile objects not
properly packed; light damages on the luggage surface, such as (only examples)
stains or scratches; signs of water on luggage with non waterproof material.
11.12. For the rights of the passengers in case of miscarriage, damage or late
delivery of the luggage, the Montreal Convention of 1999 will be applied.
11.13. In case of reporting a lost luggage, the practice remains the competence
of the airport in which the report has been made for the 5 first days; from the
sixth day, the practice is transferred to the company. Eventual requests for

12. Dangerous objects in the luggage
12.1. For security reasons, object listed below, cannot be carried in the
luggage by the passenger:
- Compressed gases (frozen, inflammable, non inflammable and poisonous) such
as butane, oxygen, liquid nitrogen, cans for scuba;
- Corrosives such as acids, alkali, mercury and batteries with liquid elements;
- Explosive munitions, pistols, capsules or tape, and fireworks;
- Liquids and solid inflammables such as gas for lighters;
- Matches, solvents, paints, lighters;
- Radioactive materials;
- Bags and suitcases that have alarm devices;
- Oxidant materials such as bleach powder, peroxide;
- Poisons and infectious substances such as insecticides, herbicide and
materials with living viruses;
- Other dangerous object such as magnetic, hurtful or irritating materials.
12.2. Medicines or cosmetics which are necessary or appropriate for the
passenger during the flight, such as hairspray, perfumes and medicines that
have alcohol, can be carried in limited quantities. Many of the above mentioned
objects can be transported as wares if packed according the respective cargo
regulation.
12.3. It is not allowed to use electronic devices of any type on board. Other
information is available on request.
12.4. The following objects can be carried:
- medicaments or toilette objects necessary for the trip to a maximum weight of
2 kg or liters;
- alcoholic drinks, perfumes or cologne to a maximum of 2 liters;
- dried ice to a maximum of 2 kg only in the hand luggage;
- smoking objects when carried by the passenger. Not allowed are however, fuel
for lighters, refills, and lighters containing liquid fuel not absorbed;
- pacemakers cardiac containing radioactive material whose batteries have
plutonium;
- small cylinders of anhydride carbonic (including sufficient refill for the
trip) carried by the passenger to operate mechanic arts;
- catalytic rolls for hair, containing oxide of carbon are allowed only in the
registered luggage. The cover should be secured on the heating element. Gas
refills are not allowed;
- with the approval of the company, small cylinders of oxygen or air for
medical use in quantities not more than 2 liters are allowed;
- with the approval of the carrier and only as registered luggage, cartridges
for sportive use, well packed in quantities not more than 5 kg are allowed.
Munitions with bullets, explosives or incendiaries are absolutely prohibited.
13.APPLICABLE DISCIPLINE AND IMPORTANT WARNINGS
13.1. The air transportation within the Italian territory is disciplined:
- by the norms of the Italian Navigation Code;
- by the dispositions of the CE Regulation n. 2027/97 and by exclusions and
limitations of the matter of responsibility of the company therein provided;
- by the General Conditions of the carrier for the transport of the passengers
and luggage, and by relative regulations; the above-mentioned General
Conditions of the company and the following regulations, make up integrant and
substantial parts of the present conditions; the same General Conditions can be
found on the back of the Boarding Passes, in any case, they can be consulted on
request at the companys offices.
The air transportation having as final or intermediary destination a different
country from the departure country, is subject to dispositions and exclusions
and limitations of responsibility of the CE Regulation 2027/97 and, for however
not provided by this, of the Warsaw Convention.
13.2. The exclusions and/or limitations of responsibility applicable to the
company will be broadened also to his agents, or representatives and all the
legal persons whose aircraft may have to be used by the company to make the
transport, same as to the agents, or representatives of the legal persons. No
agent or representative of the company has the power to modify or eliminate a
disposition of the present conditions.
13.3. A company that issues a ticket to fly with another airline, acts only as
a representative of the latter.
13.4. The registered luggage will be delivered to the owner of the Luggage
reception
13.5. Either in the national transport, or in the international ones, the
claims relating the registered luggage should be made in written form,
immediately at the moment of delivery or at the moment in which the delivery
should have been made, through special denominated modules (PIR Property
Irregular Reports), available at the airports. In case of international
transport, the claim should be presented to the company:
- in case of damaging or immediately after noticing the damage, at maximum 7
days after receiving the luggage;
- in case of delay of the delivery within 21 days starting from the date of the
delivery of the luggage.
In case of national transport, the claim should be presented to the company:
- in case of damaging or immediately after noticing the damage, at maximum 3
days after receiving the luggage;
- in case of delay of the delivery within 14 days starting from the date of the
delivery of the luggage.
13.6. The name of the company can be abbreviated on the ticket. The full name
of the carrier and its abbreviation can be found anyways in the list of prices,
regulation and timetables of the conveyor. The arrival airports are those
indicated on the ticket and that appear on the timetables of the company. The
transport to be followed with different air companies and subsequent company,
it is considered as constituent of a unique operation.
13.7. The duration of the validity of the ticket is one year starting from the
date of the purchase.
13.8. The company will have the right to refuse the transport of any person
that has purchased a ticket violating the applicable laws or tariffs and
regulations of the company.
13.9. Some special tariffs are subject to conditions that could impose
restrictions or forbid a modification of the reservation. The price of the
ticket can have a certain number of governmental taxes or different official
services, that represent at times a significant part of the cost of the air
transport. These taxes are included in price or are indicated in the taxes
box of the ticket.
13.10. The carrier undertakes to transport the passenger and the luggage with a
reasonable rapidity. The resultant hours indicated on the timetables or
elsewhere are not guaranteed and are not part of the present contract. The
transporter can, without warning, be substituted by other transporters, use
other aircrafts. He can modify the arrival airports on the ticket if necessary.
The timetables can be modified without warning. The transporter doesnt take
any responsibility for coincidences with other flights.
13.11. The operations made for buying the ticket through telephone, e-mail or
online, are regulated by the dispositions of the Legislative Decree, n.185 of
May 22, 1999 applicable to the contracts of transport and therefore contains
the exclusions of article 7 of the aforesaid decree.
14. WARNING TO THE PASSENGERS IN ACCORDANCE TO ARTICLE 6, N.2 REGULATION (CE)
N. 2027/97
Based on the Regulation (CE) n. 2027/97, in force since October 17, 1998, the
responsibility of the air company, member of the community, for damages of
death, wounds or personal injuries of the passenger, verified on board of the
aircraft or during the boarding or landing, it is not subject to any financial
limit. The company cannot exclude or limit his own responsibility for damages
to the equivalent in ECU of 100.000 Withdrawal Special Rights, providing the
proof that all the necessary and possible measures were taken to avoid the
damage; in case of damages of high importance, the company will be freed by
responsibility until he provides such proof. However, excluded by the
responsibility of the carrier are those damages that come as a result of the
negligence of the passenger. In case of immediate economic necessity, the
carrier is obliged to give a proportional payment in advance of the damage
made, and, in case of death, not less than the equivalent amount in ECU of
15.000 Withdrawal Special Rights of withdrawing per passenger. The assurance
coverage for the civil responsibility BELLE AIR is based on the Regulation.
15. SITE COPYRIGHT SOFTWARE USE
The current site is to be used personally and cannot be modified, reproduced,
duplicated, copied, distributed, sold or used in any other way for commercial
purposes. All the contents of the site, including tests, graphics, logos,
images, audio pieces are property of Belle Air and are protected by the
copyright law.
16. WARNING ACCORDING TO THE ORDINANCE 196/2003 - PROTECTION OF THE PRIVACY
16.1. The company has extreme care for the personal data given by the passenger
and adopts measures to protect their privacy..
16.2. The company, through the reservation acts and their confirmation,
acquires data relating the passengers, necessary for the fulfillment by the
same company of the contractual obligations taken towards the same passengers.
Therefore, the aforesaid data will be used exclusively for the above mentioned
ends and the lack of their conferment will not consent the carrier to execute
their own obligations.
16.3. The personal data can be communicated by the company to delegated
subjects to carry out the necessary activity for the transport and diffused
exclusively in the scope of such ends.
16.4. The passenger has the rights based on article 7 of D.Lgs. 196/2003,
therefore he will be able in every moment to: - obtain the confirmation of the
existence or not of their personal data, even if they are not yet registered,
and their statement in a comprehensible form; - ask confirmation at the
companys office of the existence of proper personal data; for each of such
requests, if the existence of the data regarding the requesting passenger is
not confirmed, an expenses contribution can be asked, not higher than the costs
effectively tolerated by the company. - obtain the indication of the origins of
the personal data, of the ends and modalities of the treatment and of the logic
applied in case of treatment carried with the supplementary of electronic
instruments, of the extreme identification documents of the official and the
responsible of the personal data treatment, also of subjects and categories of
subjects to which the personal data can be communicated or that can be
informed. - obtain the update, the ratification and integration; ask the
cancellation, the transformation in an anonym form or blocking the treated
data, by violating the law, including those of which it is not necessary the
conservation in relation with the purpose for which the data is collected or
subsequently treated, also obtain acknowledge that such operations are told to
those whose data are communicated or diffused, except the case in which such
accomplishment becomes impossible or implies an application of means
disproportionate vis--vis the copyright. - oppose the personal data that
regard him for legitimate reasons or in case the data are used to send
advertising material or direct sale or to make market research or commercial
communications, or be informed, the moment in which the data are communicated
and distributed, of the possibility to exercise free such right.
16.5. Obtaining the cancellation of the personal data is subject to a written
communication, sent through fax, e-mail or mail to the carrier office.
16.6. The proprietor of the personal data, their collection and treatment, and
